first_imgNewsAppeal Court finds Geoghegan murder conviction is safeBy Staff Reporter – June 11, 2015 1075 Twitter by Andrew [email protected] up for the weekly Limerick Post newsletter Sign Up THE MAN convicted of the murder of Limerick rugby player Shane Geoghegan had his life sentence endorsed on Monday after the Court of Appeal ruled that the conviction was safe.Barry Doyle (30) with addresses in Portland Row, Dublin and Hyde Road, Limerick failed in his bid to overturn the conviction after lodging 27 grounds for the appeal at the two day hearing.Shane Geoghegan was returning home after watching a televised rugby match at a friend’s house on November 9, 2008 when a gunman shot him several times just yards from his house in Kilteragh, Dooradoyle.Barry Doyle had been acting on the instructions of convicted killer and gangland figure John Dundon to murder another man, John “Pitchfork” McNamara who lived nearby but he killed Mr Geoghegan in a case of mistaken identity.Before Doyle’s arrest, April Collins told Gardaí that she had information about serious crimes in Limerick including a murder.She said she was with her former partner Ger Dundon the morning after Shane Geoghegan’s murder when they met Ger’s brother John and Barry Doyle in a pub car park in Limerick. John Dundon became angry when he asked Doyle to describe the man he shot after it emerged the wrong man was killed.Barry Doyle was implicated in her statement and was arrested wearing a bulletproof vest at his Limerick address.Following a retrial, he was given the mandatory life sentence by Mr Justice Garrett Sheehan on February 16, 2012.In his submission to the three judge Court of Appeal in Dublin, the 30-year-old father of one claimed that admissions made following more than a dozen Garda interviews were obtained through duress.Martin O’Rourke SC said the welfare of Doyle’s partner and child were used against him as a “tool of psychological oppression”. He was told that his partner was being held in custody away from their sick child and that he could “do something about that”.During his 15th interview in Garda custody, he admitted that he shot Mr Geoghegan in a case of mistaken identity.Mr O’Rourke also submitted that Doyle’s admissions were made without him having reasonable access to legal advice and when he decided to forgo his right to silence.Tom O’Connell SC, for the Director of Public Prosecutions, said the legitimacy of the arrest of Doyle’s partner was not raised during the trial and he confessed to the murder because “his conscience was engaged”.President of the Court of Appeal Mr Justice Seán Ryan, who was sitting with Mr Justice George Birmingham and Mr Justice John Edwards, said the appellant’s advisors legitimately advanced every ground of the objection in defending their client.The judges concluded that Doyle had engaged with his solicitor before the 15th interview and that all parties were aware of deals and counter offers made.They also agreed with the trial judge’s ruling to exclude the records of telephone calls between April Collins and her Garda liaison offocer Detective Garda James Hourihane as they were irrelevant to the case.“All of their extensive submissions were fully ventilated and carefully considered by the trial judge. The many issues were re-visited in a hearing in this court that occupied two full days of oral argument and which were also explored in comprehensive submissions that were of great assistance to the court.Mr Justice Ryan said the court was satisfied that none of the grounds of appeal could succeed.“The trial was satisfactory and the conviction of Mr Doyle was safe”, he concluded.Shane Geoghegan’s mother Mary and brother Anthony were present at the Criminal Courts of Justice in Dublin this Monday to hear the ruling.Barry Doyle gave no reaction when the judgement was handed down and saluted family members in the courtroom as he was led away. Pellegrini hopes to keep the influential 36-year-old until the end of the season and also claimed last week that Lampard wanted to stay longer. It might be that Pellegrini has to settle for a shorter arrangement – for an extra month or two – but no decisions have yet been made. Pellegrini said: “It is not just our decision. If you ask me if I want Frank to stay, of course I want him to stay. “He is a very important player for our squad and he is playing very well, as the top player he is. Maybe in the next days we will be sure but I cannot be 100 per cent at this moment.” Pellegrini’s most immediate concern is overcoming the absence of his captain Vincent Kompany and all three of his frontline strikers for the visit of Crystal Palace in the Barclays Premier League on Saturday. Kompany suffered a recurrence of a hamstring injury in his comeback match at Leicester last week while forward Edin Dzeko hurt his calf in the warm-up. We did well at Swansea and Tottenham but now this is another challenge. Pellegrini admits discussions are still ongoing but expects a positive outcome. Asked if he expected Milner to stay, Pellegrini said at a press conference: “I think so. There are some differences that can be arranged. “We are talking with James. It is not easy for all the players to sign a new contract. There are a lot of things to talk, to decide, discuss. (Editor)Dec 17 2018Loughborough University academics are to conduct research as part of a large-scale international project investigating whether personalized breast cancer screening is a better screening option for women aged 40 to 70.Dr Yan Chen and Emeritus Professor Alastair Gale, of the School of Science, say they are “very proud” to be part of MyPeBS (My Personalized Breast Screening) – a unique seven-year-long randomized clinical study that will run trials with 85,000 women from five different countries to compare personalized risk-based screening to standard screening.MyPeBS has received 12.5 million euros (£11.2m) of funding from the European Union’s Horizon 2020 research and innovation program and brings together 25 European, Israeli and American groups and institutions.Since the late 1980s, organized breast mammography screening programs have been introduced in more and more countries across Europe, and these programs have always used a “one size fits all” strategy whereby women in a target age group (typically between 50-69-years-old) are invited for a mammogram every two or three years.This approach has demonstrated benefits (reduction of breast cancer-specific mortality by 20%), however, researchers say it is not perfect and comes with side effects including false-positive findings, overdiagnosis and overtreatment.In the current strategy, all invited women are treated the same, but each woman has her own individual risk of developing breast cancer depending on factors such as genetics, lifestyle, or hormonal exposure.MyPeBS is investigating the advantages of using a new screening approach based on individual risk estimation of breast cancer.Radiologists will assess each woman and make an informed recommendation for when they should undertake screenings.For example, a woman who has a family history of breast cancer may be classed as ‘high risk’ and advised to have a yearly screening, whereas a woman with no family history of breast cancer and no other risk indicators may be told a screening of every four years would be more appropriate.The study will compare two groups of women – one following the current standard breast screening and the other following a personalized risk-based screening strategy.Related StoriesHow cell-free DNA can be targeted to prevent spread of tumorsLiving with advanced breast cancerNew study to ease plight of patients with advanced cancerIn the MyPeBS trial, some 300 radiologists will report breast screening cases across five countries – Belgium, France, Israel, Italy, and the United Kingdom – therefore it is important to monitor their performance and ensure that there is an established standard of performance and equivalence of skill levels in identifying any breast abnormalities.Dr Chen, Director of the University’s Applied Vision Research Centre, and Professor Gale will act as the quality assurance for the trials; they will analyze information provided by radiologists regarding their reporting mammographic workstation and relevant reporting room characteristics.They will also ensure the radiologists can read scans to the highest level by getting them to complete PERFORMS test sets of known challenging cases every six months in the first two years.PERFORMS is an online self-assessment and training resource for breast screening radiologists developed and ran by Loughborough University academics for the past 30 years.The results of these tests will be fed back to the participants and reported to the MyPeBS co-ordinators.Dr Chen will also compare results with the University of California (UoC), which will carry out similar assessments using their training resource, WISDOM.The UoC work is being led by Dr Laura Esserman, who was a member of President Obama’s Council of Advisors on Science and Technology (PCAST) Working Group on Advancing Innovation in Drug Development and Evaluation.Of the study, Dr Chen said: “We’re very proud to be part of the MyPeBS project.”It is important that, on the basis of sound scientific evidence, breast screening be offered appropriately and regularly to those women who most need it and less often to those women who least need it. This detailed study will determine which women are most at risk of this dreadful disease.”The MyPeBS clinical study will begin in early 2019.
